This policy explains what information we collect through jamesmontgomerylaw.com, why we collect it, how long we keep it, and what you can ask us to do with it.
Read the section on financial documents if you’re using the Business Valuation Toolkit. That section covers tax returns and financial statements, and it works differently from everything else on this site.
Who we are
James Montgomery Law is a law firm based in San Antonio, Texas. For any question about this policy, or to ask us to delete information we hold about you, write to Jim@JamesMontgomeryLaw.com.
Using this site does not make us your lawyer
Sending us information through this website does not create an attorney-client relationship, and neither does buying a valuation report. Nothing you send through a web form is privileged. An attorney-client relationship begins only when we’ve both signed a written engagement agreement.
Don’t send us confidential information about a legal matter through this site. If you have a matter you want to discuss, contact us and we’ll tell you how to send it safely.
What we collect
When you browse. Standard server and analytics information: pages viewed, approximate location, browser and device type, and how you arrived. We use it to understand which pages are useful.
When you fill in a form. Name, email address, and whatever else the form asks for. We use it to answer you, to send the material you asked for, and, if you’ve agreed to it, to send you occasional email.
When you download the book or take the assessment. Name and email address, plus your assessment answers if you complete one.
When you buy a valuation report. Your name, email address, company name and address, company website, entity type, fiscal year end, a short description of the business, how many owners work in it, whether they’re paid through payroll, and your answer to the replacement salary question. Plus the financial documents you upload. Those get their own section below.
Payment information. Payments are handled by PayPal. Your card or account details never reach us and we never store them. We receive confirmation that a payment cleared, the amount, and the email address you used.
Financial documents you upload
This section covers the tax returns, profit and loss statements, balance sheets and other financial records uploaded to the Business Valuation Toolkit.
Where they go. Into the firm’s own Google Workspace account, in the United States. We do not route them through a third-party form service or a third-party file storage service. We chose the arrangement deliberately so that your financial records sit in the same place, under the same controls, as the rest of the firm’s work.
Who can see them. The attorney and any staff working on your report. Nobody else at the firm, and nobody outside it.
How they’re protected. Encrypted in transit when you upload them and encrypted at rest while we hold them, by the platform that stores them. Access requires an authenticated account under the firm’s control.
How long we keep them. We delete your uploaded financial documents within 90 days after we deliver your report. Deleting them is a step in our report process, not an automatic timer, and we do it as part of closing out each order.
What we keep after that. The report we produced for you, and a short record of the engagement: company, contact, and the summary figures. Those aren’t your source documents and we keep them as our work product and business records.
Earlier deletion. Ask us and we’ll delete your uploaded documents sooner, at any point after your report is delivered. Write to Jim@JamesMontgomeryLaw.com and we’ll confirm when it’s done.
What we do with what we collect
We use it to deliver what you asked for, to answer you, to run and improve the site, to meet our professional and legal obligations, and, where you’ve agreed, to send you email about our work.
We don’t sell your information. We don’t rent it. We don’t trade it.
Who else touches your information
A short list, and it stays short by design:
- Google Workspace, which hosts our email and holds uploaded documents.
- PayPal, which processes payments.
- Beehiiv, which hosts and sends our newsletter.
- Google Analytics, which reports site traffic.
Each of these acts on our instructions. None of them receives your uploaded financial documents.
We may also disclose information where the law requires it, or where we need to in order to establish or defend a legal claim.
If you’re on our list, every email carries an unsubscribe link and it works. Unsubscribing stops the marketing email. It doesn’t delete the rest of what we hold, so tell us if that’s what you want.
Buying a valuation report doesn’t put you on the marketing list. That’s a separate box you tick, or don’t.
Cookies
The site uses cookies for basic function and for analytics. Your browser can block or delete them. Some parts of the site may not work properly if you do.
Security, stated honestly
We take real steps to protect what you send us: encrypted transmission, encrypted storage, access limited to people working on your matter, and a deliberate choice to keep financial documents out of third-party systems.
No system is perfectly secure and we won’t pretend otherwise. What we can tell you is where your documents live, who can open them, and when we destroy them, which is more than most services will say.
Your choices
Write to us and you can ask what we hold about you, ask us to correct it, ask us to delete it, or ask us to stop emailing you. We’ll respond within a reasonable time. Some records we’re required to keep, and we’ll tell you if that applies.
Children
The site isn’t aimed at anyone under 18 and we don’t knowingly collect information from children.
Changes
If we change this policy we’ll update the date at the top. Material changes to how we handle uploaded financial documents will be posted here before they take effect.
